ACHIEVEMENTS
NOMOS, under the leadership of Alexander Koller, represented the Austrian technology company SWARCO Futurit in the first patent infringement proceedings brought before the Local Division Vienna of the Unified Patent Court on the merits, and continues to represent it in proceedings on the preservation of evidence pending before the Munich local Division of the Unified Patent Court (EPG LK Wien UPC_CFI_33/2024; EPG LK München UPC_CFI_156/2024).
NOMOS obtained landmark rulings from the Austrian Supreme Administrative Court and the Austrian Constitutional Court on the court system in patent law. Specifically, the Austrian Supreme Administrative Court and the Austrian Constitutional Court had to clarify the question of whether there is a court system in place to appeal to the ordinary courts against decisions made by the president of the Patent Office. After the Federal Administrative Court had denied its jurisdiction and instead assumed that the Higher Regional Court of Vienna had jurisdiction, the supreme courts clarified that only decisions of the legal department and the nullity department of the Austrian Patent Office can be appealed to the ordinary courts, but not decisions in other matters related to the duties of the Patent Office (VwGH 15 May 2024, Ra 2023/03/0184; VfGH 12 March 2024, E3466/2023).
NOMOS successfully represented the Austrian Chamber of Pharmacists in a competition case. The Chamber of Pharmacists saw incorrect factual statements in advertising messages that the Austrian Medical Association, among others, distributed on TV, which constituted a misleading business practice and applied for the issuance of a preliminary injunction. After the application for a temporary injunction was rejected in the first instance, the Chamber of Pharmacists, represented by NOMOS, finally prevailed in the proceedings that went all the way to the Austrian Supreme Court (OGH 20 February 2024, 4 Ob 124/23y).
Under the leadership of Mirjam Sorgo, NOMOS won a landmark decision of the Austrian Supreme Administrative Court that strengthens the rights of those doing community service in the workplace. Specifically, the Court clarified that any damage to the health of a person performing mandatory civilian service as a result of an accident on the way to and from their home and place of work is to be included in the period of civilian service to be completed. The period during which the health of the person performing civilian service was damaged does not therefore have to be ‘made up’ by the person performing civilian service (VwGH 6 October 2023, Ra 2021/11/0064).
